& Support Information
1.
Limited Warranty
This agreement contains the terms and conditions
that apply to your purchase/lease from Custom Computer Works, on
computer systems and related products ordered from and sold to you by
Custom Computer Works as named and described on the Custom Computer
Works invoice provided to you, that relates to your order.
By your acceptance of the delivery of the computer
system and/or other products described on the invoice, you accept, and
agree to be bound by, these terms and conditions. The maximum liability
for Custom Computer Works and a Custom Computer Works repair center, or
authorized representative, is the value of the product in operating
condition at the time a claim is made by you. These terms and
conditions of this agreement are subject to change at the discretion of
Custom Computer Works without prior notice. This warranty agreement may
not be changed, altered, or supplemented to, or apply to other products
not covered by this agreement. Any attempt to change, alter or
supplement this agreement, or any change, alteration, or added
supplementation, shall render this agreement null and void unless
otherwise provided in writing by Custom Computer Works.
2.
Warranty
Custom Computer Works, in this agreement, agrees as
follows: Custom Computer Works warrants the hardware shipped or
delivered by Custom Computer Works to the customer to be free from
defects in material and workmanship for a period of one (1) year
beginning with the date indicated on the Custom Computer Works invoice
with the customer's original purchase. Custom Computer Works will
repair or replace any product in accordance with these warranty
provisions. Product repairs not covered by warranty and product updates
will be provided at a set rate subject to the customers approval.
Warranty services shall be provided during normal business hours.
3.
Repair Procedure
If the customer finds the products defective during
the Warranty Period, customer must first contact Custom Computer Works,
or a Custom Computer Works authorized repair center or authorized
representative, during the warranty period. If it is determined by the
repair center or authorized representative that warranty service is
required, a return material authorization number will be assigned to
customer by repair center. Customer shall ship the product as directed
including proof of purchase and the purchase date in the original
package (or comparable packing) and shall prepay the shipping charges.
The customer shall also insure the shipment for the full value or
accept the risk of loss or damage during shipment. In turn, Custom
Computer Works’ repair center or authorized representative
will ship repaired or replaced products back to the customer freight
prepaid if the customer lives in the United States. Custom Computer
Works owns all products repaired or removed, or products removed from
repaired computer systems and repaired parts or products made according
to standards by various manufacturers. If Custom Computer Works repairs
or replaces a product the warranty period is not extended. Unauthorized
repairs by others without the express written permission of Custom
Computer Works, or it’s authorized repair center or
authorized representative, shall void this agreement.
4.
Limitations
The warranty is void if the product is damaged by
improper or abnormal use or by accident. If the product is altered or
modified in any way or any attempt is made to repair the product
without authorization from a Custom Computer Works repair center or
authorized representative. It is solely the customers’
responsibility to determine the suitability of these products for each
particular application. Computer systems and products purchased from
Custom Computer Works and delivered to a customer are in all events not
suitable and are not authorized for use with systems potentially
injurious to life or health.
5.
What is not covered
Repair or replacement of cosmetics, damage to the
frame of the products or covering or case, and parts normally designed
to be replaced periodically or consumed during the products use,
including but not limited to batteries and cartridges, are not covered.
Loss or damage resulting from causes such as dropped products,
collision with another object, fire, flooding, sand, dirt, windstorm,
hair, earthquake damage, exposure to weather conditions, misuse, abuse
and damage resulting from improper use of any electrical source and/or
damage occurring during transport, are not covered. Consequential
damages or any damage to recording media including any program, data,
or resident setup information on any mass storage device as the result
of a malfunction or damage of any operating part or as a result of
repairs or replacements under this warranty agreement, are not honored.
Products with altered or missing serial numbers; consequential damages
from delay in rendering service under this contract, loss of use during
the period the product was covered the contract/damages occurring to
the hardware and software as a result of manufacturers’
failure to comply with ‘Year 2000’ requirements;
damages occurring as a result of software upgrades, damages occurring
as a result of downloading software and date from various sources or
loss of use during the period that the product is at a repair center,
or otherwise awaiting parts, support and coverage of operating software
are not covered in this warranty. Customer is responsible for backing
up all software and data to service under this warranty.
6.
General:
a) This Standard Limited Warranty may be changed
only by written agreement by Custom Computer Works, and shall be
constructed to be a change in.
b) Waiving any part of any default or breech of
this agreement will not constitute a waive of any subsequent default or
breech of the same or different kind.
c) The invasion of any provision of this agreement
shall not affect the validity of the other provisions hereof.
All prices, products, terms and conditions are
subject to change without notice.
